"Would Set Aside Decree
Mrs. Walker Alleges Divorce Was Procured by Fraud
Eliza J. Walker filed suit in the district court yesterday to set aside a decree of divorce which the court granted to John R. Walker October 10, 1904. The plaintiff states in her petition that the decree was obtained by fraudulent representations on the part of John Walker.
The plaintiff states that she was married to the defendant July 11, 1904, and that she came with him from Illinois to his farm in Illinois township, in this county. She alleges that through threats of violence he forced her to place her mark on a paper which proved to be a waiver of summons in a divorce suit. She says that she cannot read and write and did not understand the nature of the paper which was read to her and which she signed.
The plaintiff further states that the defendant has been guilty of gross neglect of duty and that he fraudulently contracted the marriage with her. She says that at the time of her marriage to him she was drawing a widow?s pension and had an interest in a homestead in Illinois, both of which she lost when she married him. She says that the defendant possesses valuable property in Sedgwick county.
She asked the court to set aside and declare void the decree which was granted to John Walker in October, 1904. Her attorneys are Parks & Story and Stanley, Vermillion & Evans."
